SECTION I. GENERAL INFORMATION

  • Application: These rules (hereinafter – the Rules) are mandatory provisions establishing the rights and obligations of the Buyer and the Seller (UAB FISHMART), payment, delivery, return, and other conditions related to purchases on www.fishmart.eu.

  • Conclusion of Contract: The contract is considered concluded when the Buyer completes the order (forms the basket, provides delivery details, chooses a payment method, confirms acceptance of the Rules) and clicks “Buy” or “Pay”.

  • Agreement: By placing an order, the Buyer unconditionally confirms they have read, understood, and agreed to these Rules.

SECTION II. DATA PROCESSING AND CONFIDENTIALITY

  • Required Data: To purchase, the Buyer must provide: name, surname, delivery address, email, and phone number.

  • Accuracy: The Buyer is responsible for the accuracy of the information. The Seller may cancel the order if the data is incorrect.

  • Data Protection: The Seller undertakes not to disclose data to third parties, except for partners helping execute the order (couriers, payment processors) or law enforcement as required by law.

SECTION III. RIGHTS AND OBLIGATIONS

  • Buyer Obligations: To pay the agreed amount, accept delivery, and inform the Seller of any changes to contact details.

  • Seller Obligations: To ensure website functionality, deliver goods to the specified address, and respect the Buyer’s privacy.

  • Seller Rights: The Seller may restrict access if the Rules are violated and unilaterally change these Rules.

SECTION IV. ORDERING, PRICES, AND PAYMENT

  • Prices: All prices are in Euros and include VAT.

  • Payment Term: The Buyer must pay within 1 (one) calendar day. Otherwise, the order is cancelled.

SECTION V. DELIVERY

  • Terms: Delivery takes 2–10 business days after payment confirmation.

  • Buyer’s Duties: Must provide a precise address and accept the goods personally.

  • Damages: If the package or goods are damaged, the Buyer must immediately notify the Seller via email with photos/videos.

SECTION VI. RETURNS AND EXCHANGES

  • Defective Food Products: Can be returned before the expiry date. The Buyer may choose: a replacement, a price reduction, or a refund (including shipping costs). Claims must be made within 14 days.

  • Quality Non-food/Non-perishable Items: Can be returned within 7 days in original packaging. Perishable goods (fish, seafood) of good quality are non-returnable. Return shipping is paid by the Buyer.

SECTION VII. PAYMENT PROCEDURES

  • Methods: Payments are processed via MakeCommerce. Options include major Lithuanian/international banks, VISA/Mastercard, and InBank (Moki3).

  • Reference: When making a bank transfer, the Order Number must be included in the payment reference.
